What Insurance Covers Uber Accidents?

Since it launched in 2009, Uber has transformed the transportation industry all over the world. With the touch of a button, customers can request and pay for a ride to anywhere they want to go. The existence of Uber ridesharing has made finding a ride for a night out on the town or a trip to the airport that much simpler.

While taking an Uber is convenient and easy, it does not come without risks. Uber drivers are not specifically trained for the work that they do – they have a standard driver’s license, just like any motorist. But the nature of working for Uber can be challenging. It requires long periods of time behind the wheel and navigating unfamiliar locations.

Uber drivers must have insurance coverage, but which policy is in effect and how much coverage is available depends on what they were doing when the collision occurred.

Who is Legally Responsible for an Accident Involving an Uber Driver?

Most companies are responsible for the negligence of their employees, but Uber is a little different. Uber states that it does not “employ” its drivers. Instead, they classify their drivers as independent contractors. That distinction gives Uber limited liability for the car crashes that its drivers cause.

Even though Uber is not liable for many crashes involving its drivers, it has insurance coverage to help serious collisions and accident victims. The amount of coverage available for an Uber accident depends on the circumstances of the crash. At a minimum, the Uber driver must be logged into the mobile application for Uber’s coverage to apply:

The Uber App Was Not On

If the driver was not using their app when they hit your car, then this situation would be treated like a regular car accident situation. The driver is liable for any damage or injury caused during the crash, and it is up to them to pay for any damages out-of-pocket or through their insurance company. Uber’s insurance policy will not help in any way.

The Uber App Was On But The Driver Hasn’t Connected With a Rider

If an Uber driver had their app turned on and was looking for work but was not yet connected with a rider, Uber’s insurance policy could kick in if necessary. In this scenario, the minimum insurance liability limits are up to $50,000 per individual, $100,000 per accident, and $25,000 for property damage. The driver’s insurance policy pays out first, and Uber’s insurance policy can supplement damages if necessary.

The Uber Driver is Enroute to a Rider or is Already Carrying a Rider

If an Uber driver had their app on and was about to pick up a rider at the time of the crash, or they had a rider in the car at the time of the accident, Uber’s liability coverage can come into play. Coverage at this stage is a minimum of $1 million in commercial liability and $1 million in uninsured or underinsured. Again, the Uber driver’s personal policy will likely pay out the claim first, but if your damages exceed their policy limits, Uber’s insurance coverage can act as a supplement.
